Equity Wins Buy-Out for San Francisco Cast of THE RIGHT KIND OF PEOPLE at Primary Stages

Actors' Equity has achieved a $6500.00 payment for the original cast members of THE RIGHT KIND OF PEOPLE, Charles Grodin's hit comedy about an elitist Fifth Avenue Co-Op Board, which had a sold-out run at Primary Stages this past February. The claim was pursued on behalf of the original San Francisco cast members under the Transfer Rule (69) of the collective bargaining agreement between AEA and Primary Stages, part of the Association of Non-Profit Theatre Companies (ANTC).

"We strongly believe in the intent and interpretation of this rule," said Joel Carlton, Equity's Business Representative, who initiated and successfully administered the claim. "The rule entitles members to a bona-fide offer to appear in a subsequent Equity contract production, or a buy-out, following the original production (where there are connecting elements) within 24 months. It is designed to protect cast members who participate in the creation and development of new works."

The production was presented at the Magic Theatre in San Francisco, with a cast of eight Equity members (including a Stage Manager) in the fall of 2004. That production was directed by Chris Smith, who is the Artistic Director at the Magic Theatre. Mr. Smith directed the subsequent production at Primary Stages. Eight (8) cast members from the Magic Theatre production did not receive a bona-fide offer, prompting the claim.
