Arbitrator Rules for AEA
on Off-Broadway Payments

Equity has won an arbitration decision under the Off-Broadway contract. Although the monetary value of the claim was relatively small, Eastern Regional Director Carol Waaser called this "an important case in resolving a long-standing dispute between Equity and the League of Off-Broadway Theatres about appropriate salary payments for the week containing the first paid public performance."

The rulebook permits that week to be pro-rated between rehearsal pay (which is usually at minimum) and performance pay at contractual salary, but the amount of pro-rated rehearsal pay depends on whether there was a day off in that week. The League argued that if an Actor's contractual salary is minimum, the Actor isn't due more than one week's salary for that week. Equity argued that, in accordance with the rulebook, if there is no day off in that week, the Actor could very well be entitled to more than a full week's salary. Equity won a clear decision on the matter.
