Equity, 4As "Do Not Work" Notice

All For One, One For All

Today's professional performers must be able to work in every medium: theatre, television, radio, film, the internet and other new media platforms. To protect the wages and working conditions that everyone deserves, members of one union may not undermine another union's efforts to organize professional work opportunities.

This means that if you want to accept employment in a “sister” union’s jurisdiction without an appropriate union contract, you may only do so after you have confirmed with that union that it does not object, and is not trying to organize or achieve a contract with that employer.

Actors' Equity, SAG-AFTRA, AGMA, AGVA, and the Italian Actors' Union are all members of the Associated Actors and Artistes of America (4As). Because of this we recognize, respect and support each others’ efforts to organize and negotiate fair and equitable contracts. As a member of any 4A’s union, you are bound by your union's constitution to uphold these provisions.

Actors' Equity is currently seeking a contract with the following employers, producers or organizations. Members of AEA and the 4As may NOT ACCEPT EMPLOYMENT until a contract is achieved. Please note that as stated above, if the project you are considering is not listed here, it is your responsibility to check with the appropriate union.

Please remember that if you are an Equity member, you may not accept any work in Equity jurisdiction without the appropriate contract. Even if the project is not listed here; you are still obligated to call Equity if you are offered any stage work without a union contract.

Alert: "Non-Jurisdictional" Fiction, not Fact !

AEA and 4As members should beware of ANY audition notice claiming that a production or project is "non-jurisdictional" or "not in any union's jurisdiction."

It is highly unlikely that such a claim is correct. This terminology is almost exclusively used to avoid a union contract, when one should be in place.

At this time, the theater does not have an Equity Bond in place and may not issue contracts to union members. Broadway by the Bay has recently posted an audition notice on their website and various other public locations for FOREVER PLAID which states that there is the possibility of two Equity contracts. Please be aware that Equity currently does not have an Agreement with Broadway by the Bay. "Work" for this purpose means any activity related to the production, including, but not limited to, readings, costume fittings, and so on.

While this work is in Equity's jurisdiction, we are currently in discussions as to what steps would best serve our members in this arena.

SAG-AFTRA NOTICES

Alert: Bee Audio

AEA, AGMA, AGVA and SAG-AFTRA members are advised that SAG-AFTRA does NOT have a contract with Bee Audio.

SAG-AFTRA has been actively engaged in organizing in the area of audiobooks for the last several years. In fact, the union has organized 18 audiobook producers and publishers since 2008, including Audible.com and many of its subcontractors.

Bee Audio, based in Ashland, Ore., is producing books for various major publishers but is paying half or less than half the industry-standard rates to narrators per finished hour of recording and has refused to bargain, stating in a written communication to its narrators that to do so would “involve pay increases across the board” and opting instead to maintain its current “efficient business model.”

As such, and with the unanimous support of the SAG-AFTRA Audiobook Steering Committee, the SAG-AFTRA Executive Committee, and professional narrators coast to coast, the National Board of Directors has voted unanimously to issue a “no contract, no work” order against Bee Audio. Therefore, SAG-AFTRA members are hereby informed that no member may accept work as an audiobook narrator for Bee Audio and that violation of such order may result in disciplinary action in accordance with the SAG-AFTRA Constitution.

Further to that order, AEA members may also NOT accept employment in this production without a union contract.

Alert: UPDATE Regarding Unfair Employer and Do Not Work Notice for Once Upon a Time Films, Ltd. and Sordid Productions, LLC

SAG-AFTRA has advised members that Once Upon a Time Films, Ltd. and Sordid Productions, LLC have been declared an Unfair Employer and SAG-AFTRA members may not accept employment from these companies. Because there are several entities with similar sounding names that are not involved in this matter, members are also advised to use care and contact their Local SAG-AFTRA office if they have any questions regarding the identity of the companies subject to the Do Not Work order.

The only entities declared Unfair and subject to the Do Not Work order are: “Once Upon a Time Films, Ltd.” and “Sordid Productions, LLC.” Other entities with similar sounding names, such as Del Shore’s “Sordid Lives, LLC,” and “Somewhat Sordid Publishing," are NOT parties involved in the pay dispute with SAG-AFTRA - represented performers and have not been declared unfair.

Alert: SAG-AFTRA Notice re: Nickelodeon

Please be advised that Nickelodeon is not signed to the SAG-AFTRA Television Commercials Contract or the SAG-AFTRA Radio Commercials Contract.

Although SAG-AFTRA has collective bargaining agreements with Nickelodeon covering other types of programs, members are prohibited from accepting employment for commercial services by Nickelodeon or by any other employer, unless that employer is signatory to the applicable SAG-AFTRA TV or Radio Commercials Contract.

Please be reminded that SAG-AFTRA members may not accept employment in commercials, whether for broadcast, cable or the Internet, unless the employer is signed to the SAG-AFTRA Television Commercials Contract or the SAG-AFTRA Radio Commercials Contract.

Franchised Talent Agents should check and verify the signatory status of an employer who seeks to engage their SAG-AFTRA member clients for services in a broadcast, cable or Internet commercial.

Alert: SAG-AFTRA Bulletin Re Theatrical Pic, THIS IS IT

SAG-AFTRA BULLETIN REGARDING THE THEATRICAL MOTION PICTURE "THIS IS IT"

The producer of the theatrical motion picture "This Is It" (also known as "Michael Jackson’s This Is It") is not yet signed to an agreement with SAG-AFTRA covering the terms and conditions for performers and background actors employed on the picture.

Guild members are reminded of their obligation not to accept employment on any non-signatory project, as well as their obligation to confirm with the Guild that a project is signatory. Employment on any non-signatory project within the Guild's jurisdiction may subject a member to a Rule One violation.

AEA Rescinds Hobbit 4As Do Not Work Order

On October 20, 2010, NZ Actors' Equity recommended that the international performer unions of FIA withdraw their respective member advisories prohibiting members from accepting employment on the theatrical motion picture "The Hobbit."

In light of this advisory and the recommendation from NZ Actors' Equity, Actors' Equity hereby notifies all members that they may now accept employment on "The Hobbit," under SAG-AFTRA contract terms and conditions.
